The only element of the tort the author found that could constitute the fans claim is infliction of emotional distress. This claim wouldn’t win however, due to the common tort defense of assumption of risk. As a fan that attends sporting events one assumes the risk of possibly getting hit with a football, a baseball or even a bat, whatever the case might be.
