Is reform necessary, or are critics overemphasizing those cases which appear on the surface to be frivolous?There is need for reform the structure of civil law to make it easier to learn, understand and apply to new problems. It would endeavor to address distinctive matter of fairness and policy under suitable and distinctive doctrinal headings and more appropriately allocate the duty of persuasion to the plaintiffs and the defendants. There are too many separate torts especially the intentional torts like battery, false imprisonment defamation etc. This has resulted in many different doctrinal labels that are not necessary and represent a failure to recognize the common thread to the different torts which presumptively should be sorted in a common way (Sugarman,
